Please read these Terms of Use carefully before accessing or using any part of the Skillenia Focus platform. By creating an account, enrolling in a course, or otherwise accessing our services, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
The following terms are used throughout this document:
- Platform — the Skillenia Focus website, web application, and any related digital services available at skilleniafocus.com.
- User — any individual who accesses, registers on, or uses the Platform in any capacity.
- Account — a registered profile created by a User to access Platform features.
- Content — all text, video, audio, graphics, course materials, assessments, and other materials available through the Platform.
- Subscription — a paid or free plan granting ongoing access to Platform features or Content.
- We / Us / Our — Skillenia Focus and its operators, employees, and authorized representatives.
2. Eligibility
To use the Platform, you must meet the following conditions:
- You are at least 18 years of age, or you have obtained verified parental or guardian consent.
- You have the legal capacity to enter into a binding agreement.
- Your use of the Platform does not violate any applicable law or regulation in your location.
- You have not previously been suspended or removed from the Platform for a violation of these Terms.
By using the Platform, you represent and warrant that all eligibility requirements are satisfied at the time of registration and continue to be satisfied for the duration of your use.
3. Account Registration and Security
3.1 Creating an Account
Certain features of the Platform require you to register for an Account. When registering, you agree to provide accurate, current, and complete information. You must keep your account details up to date at all times.
3.2 Account Credentials
You are solely responsible for maintaining the confidentiality of your login credentials. You must not share your password or grant unauthorized access to your Account. You agree to notify us immediately at info@skilleniafocus.com if you become aware of any unauthorized use of or access to your Account.
3.3 Account Responsibility
All activity conducted through your Account is your responsibility, whether or not you authorized it. We are not liable for any loss or damage arising from unauthorized Account access resulting from your failure to protect your credentials.
3.4 One Account Per User
Each User may maintain only one active Account. Creating multiple accounts to circumvent restrictions, access promotions repeatedly, or for any other purpose is prohibited and may result in immediate account termination.
4. Permitted Use
You may use the Platform solely for lawful, personal, non-commercial educational purposes. Specifically, you agree to:
- Access Content only for your own learning and informational benefit.
- Comply with all instructions, guidelines, and policies posted on the Platform.
- Respect the intellectual property rights of Skillenia Focus and third-party content contributors.
- Engage with other Users and instructors in a respectful, constructive manner.
5. Prohibited Conduct
You must not engage in any of the following activities while using the Platform:
- Reproducing, distributing, transmitting, publishing, or commercially exploiting any Platform Content without prior written authorization.
- Uploading or transmitting malicious code, viruses, or any software designed to disrupt Platform functionality.
- Attempting to gain unauthorized access to other User accounts, backend systems, or restricted areas of the Platform.
- Using automated tools, bots, scrapers, or scripts to extract data or interact with the Platform without our express written consent.
- Impersonating any person, instructor, or entity, or misrepresenting your affiliation with any organization.
- Posting, submitting, or transmitting content that is offensive, defamatory, discriminatory, harassing, or otherwise unlawful.
- Selling, transferring, or sublicensing your Account or access rights to any third party.
- Circumventing any access controls, digital rights management mechanisms, or technical restrictions on the Platform.
- Engaging in any conduct that unreasonably interferes with other Users' ability to use and enjoy the Platform.
We reserve the right to investigate violations and take appropriate action, including suspension or permanent termination of access, without prior notice.
6. Intellectual Property
6.1 Ownership
All Content available on the Platform, including but not limited to course videos, lesson texts, assessments, graphics, logos, and software, is the property of Skillenia Focus or its licensed contributors and is protected by applicable intellectual property laws.
6.2 Limited License to Users
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform Content solely for your personal, non-commercial educational purposes.
6.3 Restrictions
You may not copy, modify, adapt, translate, create derivative works from, publicly display, or otherwise exploit any Content without our express written permission. Downloading Content for offline use is permitted only where explicitly enabled by Platform functionality.
6.4 User-Submitted Content
If you submit any content to the Platform — including comments, forum posts, reviews, or feedback — you grant us a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute such content in connection with Platform operations. You represent that you own or have the right to submit such content and that it does not infringe any third-party rights.
7. Payments and Subscriptions
7.1 Fees
Access to certain courses and features may require payment. All applicable fees are displayed on the Platform prior to purchase. By completing a purchase, you authorize us to charge the specified amount to your chosen payment method.
7.2 Billing
Subscription fees are billed on a recurring basis according to the plan you select. You are responsible for ensuring that your payment information is accurate and current. We reserve the right to suspend access if payment fails.
7.3 Refunds
Refund eligibility is governed by our Refund Policy, which is incorporated into these Terms by reference. We encourage you to review the Refund Policy before making any purchase. Refunds are not guaranteed and are subject to the conditions outlined therein.
7.4 Price Changes
We reserve the right to modify pricing at any time. Changes will be communicated to active subscribers in advance and will take effect at the start of the next billing period.
8. Health and Wellness Disclaimer
The Platform offers educational content related to physical wellness, including senior yoga modifications. This content is provided for general informational and educational purposes only. It does not constitute medical advice, diagnosis, or treatment.
- Consult a qualified healthcare professional before beginning any exercise program, particularly if you have existing medical conditions, physical limitations, or recent injuries.
- Stop any activity immediately if you experience pain, discomfort, dizziness, or other adverse symptoms.
- Skillenia Focus is not responsible for any injury, health complication, or adverse outcome resulting from participation in or reliance on Platform Content.
By using wellness-related Content on the Platform, you acknowledge and accept these risks and release us from any related liability to the fullest extent permitted by applicable law.
9. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content, privacy practices, or availability of third-party resources. Accessing third-party links is done at your own risk and subject to the terms and policies of those third parties.
10. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you acknowledge and consent to the practices described in the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.
11. Termination
11.1 By You
You may discontinue use of the Platform and request deletion of your Account at any time by contacting us at info@skilleniafocus.com. Account deletion requests will be processed in accordance with our Privacy Policy.
11.2 By Us
We reserve the right to suspend or permanently terminate your Account and access to the Platform at our sole discretion, with or without notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to other Users, the Platform, or third parties.
11.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — will continue to apply.
12. Disclaimers
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties including, but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- Warranties that the Platform will be uninterrupted, error-free, or free of harmful components.
- Warranties regarding the accuracy, completeness, or reliability of any Content.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Skillenia Focus and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform, including but not limited to loss of data, loss of revenue, or personal injury.
In no event shall our total liability to you for any claim exceed the amount you paid to us in the twelve months preceding the claim, or a nominal fixed amount where no payment was made.
14. Indemnification
You agree to indemnify, defend, and hold harmless Skillenia Focus and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses — including reasonable legal fees — arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
15. Modifications to These Terms
We may update these Terms of Use at any time. When changes are made, the revised Terms will be posted on the Platform with an updated effective date. Continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
We encourage you to review these Terms periodically to stay informed of any updates. For material changes, we will make reasonable efforts to notify registered Users by email or by a notice on the Platform.
16. Governing Terms and Dispute Resolution
These Terms are governed by general principles of international commercial contract law. In the event of a dispute arising from or related to these Terms or your use of the Platform, the parties agree to first attempt resolution through good-faith negotiation. If informal resolution is unsuccessful, disputes may be referred to binding arbitration or another mutually agreed dispute resolution process.
17. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms of Use, together with the Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Skillenia Focus with respect to your use of the Platform and supersede all prior agreements, representations, or understandings of any kind.
